These Terms and Conditions of Use (the "Terms of Use") apply to the LUNOoOM web site located at www.lunooom.com, and all associated sites linked to www.lunooom.com, by LUNOoOM, its subsidiaries and affiliates, including LUNOoOM sites (collectively, the "Site"). The site is Property of INKBOT Labs Private limited (hereafter “LUNOoOM”) is responsible for maintaining, managing and usage of the Site.

BY USING THE SITE, YOU AGREE TO THESE TERMS OF USE; IF YOU DO NOT AGREE, DO NOT USE THE SITE.

Terms of Use mentioned below shall be binding on the User/Customer (hereafter “You” “Your”) using this website for online purchase of products or otherwise. The user agrees to have read the Terms of Use and be bound by the same. Accessing, browsing, or otherwise using the Site indicates Your Terms of Use to all the Terms of Use mentioned herein below.

LUNOoOM , provides you services subject to the notices, Terms of Use set forth in these terms (the "Terms of Use"). In addition, when You uses any LUNOoOM service, You may be subject to the rules, guidelines, policies, terms, and conditions applicable to such service and products, and they are incorporated into this Terms of Use by this reference. LUNOoOM reserves the right to change the services and product provided through the LUNOoOM and/or these Terms of Use at any time. LUNOoOM retains the right to deny access to anyone who we believe has violated any of Terms of Use. You shall be entitled to use the service and product for personal, family, office, or household use. Commercial use of the product is not allowed unless until LUNOoOM has allowed You to do so by written communication.

LUNOoOM shall solely be responsible for fulfilment of all the orders placed through this LUNOoOM including but not limited to invoicing, receipt of payment and delivery of the products to the customers.

Overview

LUNOoOM makes sand art tables, and related spare parts, materials, designs, and accessories (collectively referred to as the “Product” in these Terms of use ). To order a Product, You must register for an account. You may choose to download and use our mobile application which allows higher level control of the product.

Purchases / Returns / Support

You must be at least 18 years old to make purchases from LUNOoOM. By making a purchase from LUNOoOM , You represent and warrant to us that You are at least 18 years old.

  1. Information provided by the You

    The Users shall provide accurate information required for processing of order. LUNOoOM shall not be liable for any wrong, fraudulent information furnished by the users. Orders shall be processed subject to accurate information provided by the Users. The credit card information provided by the User shall be correct and accurate. The credit card shall lawfully be held by the User and any fraudulent use of the credit card is a punishable offence under Law.

    LUNOoOM may require some additional information for processing of order. In case any additional information is required, LUNOoOM shall get in touch with the User.

    LUNOoOM may receive sensitive information and/or Sensitive Personal data (Information) from the You. LUNOoOM shall use the sensitive information received in accordance with the Privacy Policy.

    Liabilty

    Information on this site is provided 'as is' without warranty of any kind. Information on this Web site may contain typographical errors, technical inaccuracies or other errors and may be changed at any time without notice. LUNOoOM has a policy of continuous improvement of products and reserves the right to make improvements or changes to products without notice. The actual Product may differ from the images (as its made from natural/processes wood) of the product shown on the website and LUNOoOM will not be responsible for any deviation or difference in the actual Product delivered and the images shown on the website.

  2. Ordering & Payment

    Order: Your order shall be processed subject to Your payment being processed successfully.

    Payment Mode: The Payment may be made by Credit Card, Debit card, net banking, or any other online mode of payment. We do not accept any other form of payment, including without limitation, Cash, Cheques, or money orders.

    EMI Schemes may be available by payment through select Credit Cards.

    For Your security, the billing name and address on Your credit card must match that of the information You submit. If the information provided does not match, Your order may be delayed in processing. We reserve the right to cancel any order that does not adhere to these criteria.

    Payment Methods, Promotions & Discounts offered, on products sold on this Site are subject to the discretion of LUNOoOM and may be changed frequently.

    Statutory Taxes: All purchases on Store shall be subject relevant statutory taxes.

  3. Credit Card Details

    Credit card information is not stored as the payment is done by the third party banking solutions or third party payment gateway.

    Customer/User agrees, understands and confirms that the credit card details provided by Customer/User for availing of services on LUNOoOM will be correct and accurate and Customer/User shall not use the credit card which is un-lawfully owned or possessed by Customer/User, thus Customer/User must not pay or attempt to pay for Product(s) using fraudulent credit card information. Customer/User further agrees and undertakes to provide the correct and valid credit card details on LUNOoOM.

    Further the said information will not be utilized or shared by LUNOoOM with any third parties unless required for fraud verifications or by law, regulation, or court order. LUNOoOM shall not be liable for any credit card fraud. The liability for use of a card fraudulently will be on Customer/User and the onus to 'prove otherwise' shall be exclusively of Customer/User.

  4. Delivery

    Delivery and Return –The delivery days shall be all weekdays, with an exception to National Holidays and any other public holiday. Delivery shall be made within specified number of days mentioned during time of purchase. The delivery shall be made by a third party logistics partner of LUNOoOM and LUNOoOM shall not be responsible for any delay in delivery of the Products. The Buyer/Customer specifically waives any claim pertaining to delay in delivery of Products.

    Return Policy –The damaged goods maybe returned subject to the policy of LUNOoOM. Customer may return any new product purchased from Store that arrives in damaged condition or has any major variance from the agreed specifications. LUNOoOM reserves the right to test and inspect the product and impose a customer fee upto 100% of the product sale price and transportation cost, if the Customer misrepresents the condition of the product. Any product i.e. damaged through customer misuse has missing parts or is in an unsalable condition due to customer tampering will not be accepted for returns. LUNOoOM will not accept return of any product more than 14 days after customers receives the shipment.

    Unless you have received a damaged or defective product or a product different than the one you have ordered, you are responsible for shipping charges and shipping the product back to our facility near Pune.

    To initiate a return or warranty claim, please follow these steps:

    Contact our customer support team at hello_at_lunooom_dot_com to inform them about the return or warranty claim.

    Provide the necessary details, including your order number, a description of the issue, and any supporting documentation or photos.

    Our customer support team will guide you through the return process or assist with the warranty claim.

    Warranties - LUNOoOM offers a one-year limited manufacturer warranty for all new LUNOoOM-branded products, protecting against any defects in materials and workmanship. The specific terms and conditions of this warranty can be found in the Warranty section www.lunooom.com/warrenty . It is important to note that LUNOoOM's one-year manufacturing warranty is provided separately from and in addition to any consumer protection rights granted under Indian Consumer Law.

    Cancellations

    We do not accept cancellation on signature collection products after seven days from the date of order, as each signature collection product is made to order. This policy applies to custom or modified tables by LUNOoOM.

    LUNOoOM allows you to cancel your order and receive a refund if you cancel order before shipping. A cancellation charges of 25,000 INR will be applied as order processing charges.

    LUNOoOM reserves the right to accept or cancel orders for any reason. The customer agrees not to dispute the decision made by LUNOoOM and accept LUNOoOM decision regarding the cancellation. LUNOoOM also reserves the right to cancel Your order in case of:

    • Problems identified by our credit and fraud avoidance department.

    • Inaccuracies or errors in Product or pricing information.

    • Non-availability of product ordered.

    • Any other reasons beyond reasonable control of LUNOoOM

    LUNOoOM may also require additional verifications or information before accepting any order. LUNOoOM will contact You if all or any portion of Your order is cancelled or if additional information is required to accept Your order. If Customer’s order is cancelled after Customer’s has been charged, the said amount will be returned back/refunded to the same account of Customer. The amount shall reflect in Customer’s account as per its banker’s policies.

  5. Typographical Errors

    This website LUNOoOM may contain any typographical error including pricing and if a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing, LUNOoOM shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. LUNOoOM shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and Customer has been charged. If Customer has already been charged for the purchase and Customer’s order is cancelled, the said amount will be returned back/refunded to the same account of Customer.

    Indemnity

    User shall at all times fully indemnify and hold harmless LUNOoOM and/ or lunooom and their officers, directors, agents, and employees, associate companies from any and all costs, losses, claims, demands, damages and liabilities , actions including costs and reasonable attorneys' fees, made by any third party and/or penalty imposed due to and/or arising out of User's breach of the Terms of Use and/or User's violation of any law, rules or regulations and/or the rights of a third party and/or the infringement by User including, without limitation, intellectual property rights infringement, obscene and/or indecent postings, and on-line defamation, and/or any third party using the User's account, of any proprietary and/or other right of any person and/or entity.

  6. Intellectual Property

    LUNOoOM brand is Property of INKBOT Labs Private limited. This Store Website (hereinafter termed as “Site”) is owned by INKBOT Labs Private limited and is maintained and managed by INKBOT Labs Private limited. The website is a Copyright of INKBOT Labs Private limited protected by Copyright Laws of India. Any unauthorized copy, imitation of the website including but not limited to unauthorized copy, imitation of the contents, material, design of the website is unlawful and is a punishable offence as per Indian Copyright Act, 1957. All material on this site is provided for lawful purposes only. None of the information on this site may be copied, distributed or transmitted in any way for commercial use without the express written consent from the LUNOoOM. Users may use or download the content or material on the website for personal, non commercial use provided the contents are not altered and modified in any way.

    The LUNOoOM system is patent pending.

  8. Sand Track Designs Licensed

    All Sand Track Designs are property of LUNOoOM.

    Force Majeure

    LUNOoOM will not be liable to You for any delay in delivery of the Product including any delay or lack of access due to an event beyond LUNOoOM reasonable control, such as an act of God, terrorism, war, political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man-made condition outside of LUNOoOM control. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms of Use ,any Order or Contract that is caused by events outside our reasonable control.

  9. Governing Law

    This Terms of Use and any sales hereunder shall be governed by the laws of India. The Parties to the dispute shall make all endeavours to settle their disputes amicably. If the Parties are unable to settle their dispute amicably the dispute shall be resolved as per applicable Law. The disputes shall be settled as per Laws of India and shall be subject to the Jurisdiction of Courts of Pune, Maharashtra, India.

MODIFICATIONS TO THE POLICY

We reserve the right to modify this Warranty and Return Policy at any time without prior notice. Any changes will be effective immediately upon posting on our website.

Use of the LUNOoOM sites/services is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. you agree to indemnify and hold LUNOoOM’s subsidiaries, affiliates, directors, officers, and employees, harmless from any claim, demand, or damage, including reasonable attorneys' fees, asserted by any third party due to or arising out of your use of or conduct on the LUNOoOM site/services. LUNOoOM reserves the right to disclose any personal information about you or your use of the LUNOoOM site/services, including its contents, without your prior permission in case asked by the law.

If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and LUNOoOM with respect to the LUNOoOM site/services and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and LUNOoOM site/services.
